The Insurance Question Isn't Simple — and That's the Point
Rideshare companies structure their coverage in tiers specifically so that liability shifts depending on the driver’s status. Adjusters — both the rideshare company’s and the driver’s personal insurer — often point to each other, hoping you give up before either one pays. Sorting out which policy actually applies is the first and most important step in a rideshare claim.
Georgia's Three-Period Insurance Framework
Under O.C.G.A. § 33-1-24, Georgia's Transportation Network Company Act, coverage depends on the driver's app status at the time of the crash: Period 1 (app on, waiting for a ride request): $50,000 per person / $100,000 per accident in bodily injury coverage, plus $25,000 in property damage — and it's often only contingent, meaning the driver's personal policy has to be exhausted first. Periods 2 and 3 (ride accepted through drop-off): $1,000,000 in primary third-party liability coverage.
The Coverage Gap That Catches People Off Guard
Many rideshare drivers carry only minimum personal auto coverage, and some personal insurers deny claims outright once they learn the driver was working for a rideshare app — even if the app was off. If the crash happened during Period 1, your claim may hinge on coverage that's far thinner than most people assume.
Passengers Are Rarely at Fault — But That Doesn't Mean the Claim Is Simple
As a rideshare passenger, you're almost never assigned fault for the crash. That doesn't make the claim straightforward — it usually means untangling which of several available policies pays first, and how much.
Two Years to File
Georgia's statute of limitations for a rideshare accident injury claim is two years from the date of the crash (O.C.G.A. § 9-3-33), the same as any car accident claim.
What Rollins Law Group Pursues on Your Behalf
Most car accident victims are entitled to more than what an insurance company’s first offer reflects. Our team calculates the full scope of what your case is worth — then pursues it.
Economic damages
Economic damages cover emergency care, surgery, physical therapy, ongoing treatment, lost wages, reduced earning capacity, and out-of-pocket costs tied to your recovery.
Non-economic damages
Non-economic damages cover the physical pain you live with, the emotional toll of the crash, and the impact on your relationships and quality of life.
Punitive damages
Punitive damages may apply in cases involving inadequate driver screening or a driver under the influence, where the rideshare company or driver acted with reckless disregard for passenger safety.
Types of Rideshare Cases Our Firm Handles
Injured as an Uber or Lyft passenger
Passengers are almost never at fault, but recovering full compensation still requires identifying which of several possible policies applies.
Struck by a rideshare vehicle as another driver
Fault is determined the same way as any car accident, but the applicable insurance depends entirely on the rideshare driver’s app status at the time.
Struck by a rideshare vehicle as a pedestrian or cyclist
Pedestrians and cyclists hit by a rideshare vehicle can pursue a claim against the same tiered insurance coverage that applies to passengers and other drivers.
Rideshare driver assault or negligent-hiring claims
When a rideshare company fails to properly screen a driver, the company itself may bear direct liability separate from the driver’s insurance.
Accidents during driver pick-up or drop-off
Crashes that happen while a driver is maneuvering to reach or drop off a passenger fall under the highest tier of rideshare insurance coverage.
Accidents involving a rideshare driver with the app off but working
Drivers who are technically off-app but still engaged in rideshare-related activity can create coverage disputes that require careful investigation.
What Is a Rideshare Accident Case Worth in Georgia?
Rideshare accident value depends less on a flat formula and more on which insurance tier applies to your crash — the gap between Period 1 and Periods 2–3 coverage is enormous, and it drives almost everything else in the case.

Questions Atlanta Rideshare Victims Ask Us Most
Liability depends on the at-fault driver, but as a passenger you can typically pursue the rideshare company's insurance coverage, which is substantial once a ride is accepted or in progress.
If the app was off, the driver's personal auto policy typically applies, and coverage disputes are common — this is where investigation matters most.
Rideshare companies classify drivers as independent contractors, which limits direct liability, but claims for negligent hiring or screening failures can sometimes be brought against the company directly.
It depends on the driver's app status: as little as $50,000–$100,000 during Period 1, up to $1,000,000 during Periods 2 and 3.
You can pursue a claim against the same tiered insurance coverage that applies to passengers, depending on the driver's app status at the time.
Georgia's statute of limitations is two years from the date of the crash under O.C.G.A. § 9-3-33.
